By using our services, you agree to all of these terms. This Agreement applies to the workerpark.com platform, workerpark-related communications and other services referred to as provided under this Agreement ("Services"), including off-site data collection for such Services, such as our advertisements and dedicated plug-ins. Registered users of our services are "Members" and unregistered users are "Visitors". Conclude this Agreement with Workerpark (also referred to by various grammatical forms of the pronoun "new"). Our terms and conditions do not directly create an agreement between different members. Our terms and conditions are a contract between Workerpark and each individual member. II. Revisions to this Agreement.

By continuing to use the Platform after any changes have taken effect, you agree to the revised Agreement. III. Account and membership.

You must be at least 18 years old to use our Platform. Our platform is available to anyone who is at least 18 years old. Declare that you are at least 18 years old. In order to use our services, you agree that: (1) you must be a minimum age (defined below) or older; (2) you will have only one Workerpark account, which must be with your real name; and (3) Workerpark has not already restricted your access to the use of the services it provides. Creating an account with false information is in violation of our provisions, including the creation of accounts registered in the name of others or persons under the age of 18.

"Minimum age" means the age of 18. However, if the law requires you to be older in order for Workerpark to legally provide you with Services without parental consent (including the use of your personal information), then the Minimum Age is this age.

IV. Modifying, suspending and closing your account.

We may modify, suspend or terminate your account or access to the Platform if, in our sole discretion, we determine that you have violated this Agreement, including any policies or guidelines contained in this Agreement, which are in the best interest of the Workerpark community. or to protect our brand or Platform. V. Account and security information.

When you sign up for an account, you provide us with some basic information, an email address and a password. Keep your email address and other account information current and accurate. You also agree to keep your password secure and confidential (or we may need to deactivate your account). We strongly encourage you to choose a strong and unique password that is not shared with any other online account or service, and to practice other healthy password security practices to prevent unauthorized access to your account. VI. Workerpark Platform and Services License.

Subject to your compliance with this Agreement, Workerpark grants you a limited, non-exclusive, revocable, non-cancellable and non-transferable right to use the Platform to access and use the services and features we provide to you.

VII. Payment.

Taxes, payments and offers. We charge for certain functions on our Platform. If you take advantage of these functions, you are responsible for paying the related fees. Use of some of the functions on our Platform is free of charge and we charge fees for other functions. In the future, we may implement a new fee or modify an existing fee for certain current or future features of our Platform. If we implement a new or changed fee, we will notify you in advance by posting changes on our Platform or by sending an email. You agree to pay these fees and any associated fees for your continued use of the applicable service. Unless otherwise specified, all taxes and transactions are in euro (EUR). The services are provided immediately after payment and therefore a refund is not possible. Members who opt for additional features are responsible for their payment through our approved payment methods. You may only pay fees to Workerpark using a valid payment method acceptable to us, as specified by the Platform. If we close, suspend or cancel your account in connection with this breach of this Agreement, we are not liable to refund any fees paid to Workerpark. You represent and warrant that you are authorized to use the payment method you designate through the Platform. You authorize us (and our designated third-party payment processors) to charge the designated payment method for the full amount of any fees you owe to Workerpark, including any other applicable fees. If the payment method cannot be verified, is invalid, or is not accepted by us, your payment may be suspended or canceled. We reserve the right to adjust or instruct our payment processors to make adjustments to a payment that has already been requested or received, in order to correct errors or mistakes in accordance with our payment policies.

The services for which payments are requested on our platform are those within the "Buy an ad", respectively the profile promotion service. The "Buy an ad" fee is charged for each ad in order to reveal the details of the offer you choose. The profile promotion service involves the creation of a profile, followed by the payment of a sum of money for its promotion, the amount being calculated in relation to the territory on which the promotion is desired, depending on the user's option. The amount of money paid for the promotion of the ad per word/country/day depending on the user's choice. At the end of this period, the user will not be billed for the recurring fee, but will receive a notification before the end of the period to be notified of this. VIII. Content.

Your content and privacy. You are responsible for the Content that you post on our Platform or that you send to us. You grant us a license to use this Content to operate, enhance, promote and protect our Workerpark and Platform. You are responsible for the content that you post on the Platform or otherwise provide to Workerpark. You agree and understand that the profile created may be shared by other members or by you, unless the profile is private. When creating your profile, a QR code is generated that works offline and facilitates the distribution of your profile in the form of a business card.

You agree to provide only content or information that does not violate a person's law or rights (including intellectual property rights). You also agree that your profile information will be accurate. Workerpark may be required by law to remove certain information or content in certain countries.

IX. Use of the platform.

Use of our platform. We ask that you comply with our policies and rules when using our Platform. We have no responsibility for the Content that someone posts on our Platform. When you use our Platform, we ask that you comply with our usage and content policies.   • Interfere with the operation or overload of services (eg spam, denial of service, viruses, game algorithms);

The content of others. Workerpark does not control the content of other members. When we discover inappropriate content on our Platform, we reserve the right to investigate and take appropriate action, but we have no obligation to monitor or assume responsibility for the Content of other members.

Interactions with others. Workerpark does not perform or request background checks on members and does not attempt to verify the truth or accuracy of statements made by members. Workerpark makes no representations or warranties regarding the conduct or content of any member or their interactions with you. If you have a problem with other members, you may report it to office@workerpark.com.

Prohibited uses of the Platform. Our platform contains proprietary and confidential information and is protected by intellectual property and other laws. Unless expressly permitted by this Agreement, you agree that you will not, directly or indirectly.

(a) use, host, store, reproduce, modify, publish, publicly display, publicly execute, distribute or create derivative works of the Platform or any part of the Platform;

(b) remove or modify notifications from the Platform;

(c) reverse engineer, disassemble, decompile, or attempt to discover the source code or structure, sequence, and organization of the Platform; and;

(d) rent, license, resell, distribute or use the Platform for commercial purposes not covered by this Agreement.

You further agree that you will not use the Platform to request or collect (i) personal data from others, or (ii) sensitive personal data, as defined or treated as such in accordance with applicable law (including only for example, health information and social security numbers and other government identification).

XI. Platform safety and security.

You agree that you will not, directly or indirectly:

XII. Intellectual property.

- A statement by you that the above information in your notice is accurate and, under penalty of misrepresentation, that you are the owner of the copyright or intellectual property or that you are authorized to act on behalf of the owner.

- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.

Please note that we may send a copy of any legal notice we receive to a member who is allegedly in breach of its contents,

What should I do if the content I've posted has been removed or I've been notified that my content infringes someone's intellectual property rights? If the content you posted was removed or you received a notice that your content infringes someone's intellectual property rights, you can send us a counter-notification to challenge the issue. Please send this information in the manner described above, as in the case of a claim / notification of infringement of intellectual property rights.

XIII. Notifications, final provisions, termination.

Except as otherwise provided in this Agreement or unless expressly required by law, any notice to us will be mailed to the Workerpark at: Legal Department, Baia Sprie, str. Ignisului no. 86, Maramureș County, RO, or by e-mail at office@workerpark.com Any notification to you will be sent to the most recent e-mail address in your account.

This agreement constitutes the entire agreement between you and Workerpark. A Workerpark Platform member is not a Workerpark representative or agent and cannot enter into an agreement on behalf of Workerpark.

You agree to provide us with notifications and messages in the following ways: (1) within the service or (2) sent using the contact information you provided to us (e.g., email, mobile phone number, address physics).

Applicable law. This agreement and the relationship between you and Workerpark will be governed by applicable Romanian and EU law.

You and Workerpark agree that any legal proceedings (other than actions for minor claims) must be brought exclusively within the means of dispute resolution provided by the European Commission or at state courts located in Cluj-Napoca, Romania and you and Workerpark agree with your personal jurisdiction in those courts. If you are a member of the European Union, you may bring legal proceedings against us arising out of or in connection with this Agreement in your country of residence. In addition, for the European Union-based members, the European Commission provides an online dispute resolution platform.

Assignment. This agreement is not assignable, transferable or sublicensable by you except with the prior written consent of Workerpark. Failure by a Party to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision, nor a waiver of a right to act in respect of subsequent or similar infringements.

If any provision of this Agreement is held to be invalid by a court of competent jurisdiction, you and Workerpark agree, however, that the court should endeavor to implement the parties' intentions, as reflected in the provision, and that the other provisions of this Agreement shall remain in full force and effect.

Termination. If your account is closed or access is blocked, this Agreement will be terminated in respect of the account of a member who has been terminated, but the provisions necessary to implement the Agreement will survive the termination or expiration of this Agreement.

Section titles of this agreement are for convenience only and have no legal or contractual effect.

Workerpark takes the privacy of your membership account very seriously and has strict rules about who can access or create a Workerpark account. Please note that we reserve the right to suspend or remove any account or limit access to certain features of the platform, for any reason, in our sole discretion.

XIV. Reporting.

If another Workerpark member posts or submits inappropriate content or spam, we encourage you to submit a report. The reports help us keep the platform safe and enjoyable for all users. Spam messages are commercial in nature, unsolicited on the site and unsolicited. Inappropriate content can be anything from a derogatory comment to an offensive photo. An accurate report of the situation helps us to respond quickly and efficiently. Please do not select the spam option if you are not reporting a commercial, ad or unsolicited message. Workerpark's reliable and safe team reviews all reports and takes appropriate action. If there is no specific content or message to report, you can report a member account from the profile page. Report a Member Desktop Web Member - Go to Member Profile - Click Report - Select the reason for your report from the drop-down menu - Click Next - Go to Member Profile - Tap the three-dot icon in the top right corner - Select Report from the drop-down menu down - Select the reason for your report - Tap Next.

Profile information created on the Workerpark platform may be visible to search engines or other Workerpark members, unless you activate private profile mode. You can edit your privacy settings on the Privacy Policy page.

XV. Visibility of information.

What information is visible on a Workerpark profile? When you create a Workerpark account, the basic account information appears in your Workerpark profile. You can edit this information on the Account page. If you choose to create a Workerpark profile, the information listed in your Workerpark profile may be visible to Workerpark members, non-members, and search engines, including: Name, Account location, Profile picture, Date - "Member from", Things (editable from privacy page)..

Creating an account is different from creating a profile. All you need to create an account is a valid email address and password. The account allows you to browse the platform. On the other hand, creating a profile involves creating a "business card", with all the related information and about which distribution is allowed, including through the QR code function in offline mode. Through the profile you have an increased visibility which raises the chances of concluding a collaboration and you can also benefit from the promotion services in the territories you choose.

Workerpark members can choose between two content visibility settings: public or private. These settings determine how much of the information is visible to non-members and search engines. Profile information listed on a public group page may be visible to Workerpark members, non-members, and search engines, including: Name, Account location, Profile picture, Date "Member from", Interests (editable from page confidentiality), professional and biographical data. When the profile is set to private, it is not visible.

Search engines crawl and record billions of public web pages, including workerpark.com. If you list your full name or other information about yourself in your Workerpark profile or on any public page on the Workerpark site, search engines may see it. If you find search engine results that show personal information on Workerpark that you do not want to be publicly visible, edit the information on the Workerpark website. To edit your personal information, visit your Account page. Once you've edited or deleted the information, it will no longer appear on the Workerpark site. However, this information may still appear in search results as cached versions of Workerpark pages. Search engines will update the memory of these pages the next time they crawl the Workerpark site. When this happens, the search engine will replace the old copy of the personal information page on it with the latest version that does not contain personal information. We can't control exactly when Google or any other search engine updates its results, but usually lasts 30 days.
